Understanding the Zero Tolerance Law in California
For most drivers, to be legally found guilty of drinking and driving, you must have a BAC of 0.08 percent or higher. This, however, is not the case for drivers who are under the legal drinking age of 21. In the state of California, they have adopted what is known as a "Zero Tolerance" law. Under this law, if you are found to be driving with a BAC of as low as 0.01, you could be arrested.
Per this law, you can have your license suspended for one year if you do any of the following:
- Have a BAC that is 0.01% or higher;
- Refuse to take the preliminary alcohol screening test; or
- Fail to properly complete the preliminary alcohol screening test.
